1. Yoveletta Reservation System
Yoveletta is a reservation system operated by Yoveletta Vertriebs GmbH. Yoveletta Vertriebs GmbH has its registered office at Flurweg 14, 3072 Ostermundigen, Switzerland.
2. Acceptance of the Terms of Use
These Terms of Use apply to the use of the Yoveletta reservation system, which processes reservations through various online channels as well as manually. By using the Yoveletta reservation system operated by Yoveletta Vertriebs GmbH, you agree to these Terms of Use and the Privacy Policy contained herein. Yoveletta Vertriebs GmbH reserves the right to make changes or additions to these Terms of Use at any time. Users of the reservation system expressly agree to this procedure.
3. Usage Policy
Your use of our reservation system and the transmission of your user data are voluntary and free of charge. To make a reservation, we require your first and last name, telephone number, email address and, where applicable, depending on the restaurant, an accepted means of payment. Additional personal data may be requested as required. If you have any questions or concerns regarding your reservation, please contact the restaurant directly. The relevant contact information can be found in your reservation confirmation. You are required to cancel reservations that you are unable to attend in good time and in advance. Reservations that are not attended and not cancelled in good time may result in your telephone number being blocked in the reservation system and/or a fee being charged by the restaurant using the means of payment you provided as part of the reservation (no-show fee). The conditions for charging such no-show fees and the amount thereof may vary depending on the restaurant and will be displayed to you before completing the reservation and submitted for your express consent.
4. Data Protection
Yoveletta Vertriebs GmbH places great importance on protecting your privacy and the security of your personal data stored through the Yoveletta reservation system. Yoveletta Vertriebs GmbH protects your data against loss, misuse, unauthorized access, disclosure, alteration or destruction through technical and organizational measures. Our security measures are continuously improved in line with technological developments.
When using the reservation system, you send us data such as your first and last name, telephone number, email address, date, time, desired number of guests and comments. Additional personal data may be requested as required. This data is necessary to process a reservation and is made available to the restaurant for further processing of the reservation and stored by Yoveletta Vertriebs GmbH. Any further use of your data (for example, for sending offers and notifications from restaurants to you) will only take place if you have expressly given your consent. You may revoke this consent at any time. Restaurants cannot access guest information or statistics of other restaurants via Yoveletta. The only exception is that restaurants operated by one or more affiliated companies (restaurant groups) may share information about restaurant guests between the individual restaurants.
Yoveletta Vertriebs GmbH sends you automatic service notifications by email or SMS on behalf of the restaurants, which are directly related to your reservation. These include confirmations, changes, reminders or cancellations, information about the reservation and requests to provide feedback about your visit. Your data will not be disclosed to third parties for advertising purposes. Yoveletta does not store or process payment data. The payment process for any no-show fees is handled by an internationally certified, PCI-compliant external service provider (payment gateway provider).
When you use the Yoveletta reservation system, cookies may be stored on your computer depending on your browser settings. A cookie is a short text snippet sent by a website you visit to your browser. Some cookies are required for the functionality of the website and are automatically deleted after your visit. Other cookies store information about your last visit, such as your preferred language or other settings. This allows you to navigate the website more quickly and use it more effectively the next time you visit it. We also use third-party cookies, on the one hand for statistical analysis of the use of our reservation system and, on the other hand, for displaying personalized advertising offers from third parties. One example of a statistical analysis service is Google Analytics, a service provided by Google in the USA. Google uses cookies to collect information about your behavior in our reservation system and about the device used to access it (tablet, PC, smartphone, etc.), such as information about your browser, the website from which you accessed our website, the name of your provider, your IP address, the date and time of access to the website, pages visited and time spent on the website and, where applicable, visits to other websites and apps. Based on this information, we receive analyses from Google. Google stores this information in the USA; however, your IP address is shortened beforehand in the EU or EEA. 5. Disclaimer of Liability
Yoveletta Vertriebs GmbH does not guarantee that the reservation system will be available continuously and without errors. Yoveletta Vertriebs GmbH has the right at any time to remove functions from the reservation system, add new functions, transfer the operation of the reservation system to third parties or discontinue its operation.
Yoveletta Vertriebs GmbH strives to ensure a high level of quality, care and availability of our digital services, but cannot exclude temporary restrictions and outages (operational interruptions, troubleshooting, maintenance work, etc.). Your access to and use of the reservation system is at your own risk. Any warranty with regard to our services and products is expressly excluded.
Furthermore, Yoveletta Vertriebs GmbH shall not be liable for services provided by third parties. This applies in particular to services provided by restaurants as well as links to content and offers from third parties, for the legality, accuracy, completeness and availability of which we assume no responsibility or liability. Yoveletta is also not liable for disruptions or incorrect execution of payments (in this regard, please contact the issuer of the means of payment you provided as part of the reservation), the lawful use of the means of payment provided by you by restaurants, their employees and assistants or third parties, or compliance with applicable data protection regulations and appropriate data security measures, in particular by restaurants and payment gateway providers. We are likewise not liable for damage caused by computer viruses or other harmful computer programs such as malware or spyware.
The liability of Yoveletta Vertriebs GmbH (including its affiliated companies, employees, representatives and agents) is in all cases limited to intentional or grossly negligent breaches of obligations for which Yoveletta Vertriebs GmbH is responsible and which have been proven. To the extent permitted by law, the liability of Yoveletta Vertriebs GmbH is limited in each case to the amount charged to you for the purchase of the relevant paid products. Yoveletta Vertriebs GmbH shall not be liable for consequential damages or loss of profit.

The reservation system may contain links to websites operated by third parties and not by Yoveletta Vertriebs GmbH. Yoveletta Vertriebs GmbH has no control over these websites and is not responsible for their content.
7. Intellectual Property Rights
It is assumed that the information and software accessible through this website are protected by copyright and that their commercial use is only permitted with the consent of the copyright holder and against payment of a fee.
8. Severability Clause
Should individual provisions of these Terms of Use be invalid, this shall not affect the validity of the Terms of Use as a whole.
9. Applicable Law and Jurisdiction
These Terms of Use and all related actions shall be governed exclusively by substantive Swiss law, excluding the conflict-of-law provisions of Switzerland and your place of residence. Subject to any mandatory statutory provisions to the contrary, the exclusive place of jurisdiction for all disputes arising in connection with these Terms of Use shall be the City of Bern.

These Terms of Use are available in German and English. In the event of any ambiguities or inconsistencies, the German version shall prevail.
